Michael Dunn Trial: Jury Reaches Verdict on 4 of 5 Charges, Not on Count 1

#DunnTrial:  The jury in the Michael Dunn murder trial reached a verdict on four of five charges, but are unable to reach a verdict on Count 1, the murder charge and lesser charges in the death of 17-year-old  Jordan Davis.

Judge Russell Healy read the Allen Charge (#AllenCharge), which says the jury must go back and try to reach a verdict. If they are unable to do so, a mistrial will be declared on Count 1. I am appalled that, with all the inconsistencies in Michael Dunn’s statements, that some on the jury seemed to believe his self-defense argument.

It’s sad that Jordan Davis’ parents are literally left without justice for their son. It’s ironic that Michael Dunn had only seen his own son three times in 15 years, but sought to discipline another man’s child. Jordan Davis’ dad, Ron Davis, played a role in his child’s life. He wasn’t an absentee Dad like Michael Dunn is.

CNN is reporting the Jordan Davis’ family is distraught on hearing about first degree, second degree and manslaughter charges on the murdered teen’s behalf.

It should be noted that if Michael Dunn is found guilty on the other charges, Florida law calls for a mandatory minimum sentence of 20 years for each count of attempted murder. Each of those sentences must be served consecutively and not concurrently. He will not get out early for good behavior. He must serve the entire sentence, which would be 60 years.

The family of Trayvon Martin issued a statement through their attorney Benjamin Crump:

Nelson Mandela once said, “may your choices reflect your hopes, not your fears.” The killing of 17 year old Jordan Davis is yet another reminder that in Florida, racial profiling and stereotypes may serve as the basis for supposititious fear and the shooting and killing of young teenagers. No matter the verdict, the fact that Ron and Lucia will never see their son again will not change; we know that pain all too well. We walk with Jordan in defining his legacy to reflect our hopes by advancing love and tolerance in his memory, and continuing the fight against unjust gun laws.

#DunnTrial:  Jury deliberations in the murder of 17-year-old Jordan Davis by Michael Dunn after an argument about loud “thug music” in the parking lot of the Gate gas station that turned deadly, enters the fourth day. The deliberations in this case were longer than deliberations in the Casey Anthony, George Zimmerman and O.J. Simpson cases. Yesterday the jury asked the judge if they were able to return a partial verdict on four charges and not on one. My guess is that the jury may be hung on the murder charge, possibly because they don’t believe his self-defense argument. We’ll see.

It’s worth stating that even if a mistrial is declared on the murder charge, Michael Dunn is looking at a long prison sentence on the other charges. That’s assuming he is found guilty of attempted murder of Jordan Davis’ three friends and firing a gun into a vehicle. Michael Dunn admitted to firing at the vehicle as it left the gas station. Surveillance tapes captured the delay before the second volley of gunshots were fired. If they believe Michael Dunn didn’t fire in self-defense, he could be convicted of attempted murder and that carries a minimum sentence of 20 years. The word is that Judge Russell Healy most likely won’t allow him to serve those three 20-year prison terms concurrently. Michael Dunn would be facing 60 years in prison. That would make him 100 by the time the terms expires.

A hung jury could also come as the jurors are unable to reach a verdict. If that were to occur, the case would be retried in weeks or months, depending on Judge Healy’s calendar. Jordan Davis’ parents and Michael Dunn’s attorney Cory Strolla, said they believe the jury is taking its time in discussing the evidence. Yeah, they are having a discussion for sure, but they are deadlocked. That’s evident from the questions they have asked the judge.

Well, we’ll see how Day 4 goes. Sadly, we’re still on a #VerdictWatch., one day before Jordan Davis would have turned 19.

Jordan Davis’  family attorney, John M. Phillips, released a tape to counter defense attorney Cory Strolla’s claims that Michael Dunn has never been enraged or accused of being a racist. In other words, Jordan Davis’ murderer had a “calm demeanor” and he was really in fear of his life after an argument about “thug music” led to him shooting inside an occupied SUV.

In a statement, John Phillips reveals his reason for releasing the video now:

In response to Mr. Strolla’s recent comments, I have been authorized to release this videotaped statement I took of Mr. Dunn’s former neighbor in the defamation/death lawsuit. Charles Hendrix lived next to Michael Dunn for 8 years.

What Charles Hendrix has to say about Michael Dunn won’t surprise you:

“He was light and friendly and he laughed, but if you disagreed with him he would get boisterous and try to be overbearing and try to intimidate people with his size and voice.”

He appeared to me to be very selfish and there wasn’t much he wouldn’t do to get what he wanted and to get his way. Very arrogant.”

The fact is Cory Strolla’s press conference was unprofessional and ill-timed. He attacked Ron Davis, the father of the victim, as well as asserted that Angela Corey was politically motivated for bringing the case to trial. He claims also claims if there had been no George Zimmerman case, this wouldn’t have been tried in the first place. Um, I beg to differ. This case is very different from the Zimmerman trial. There was a struggle that led to Trayvon Martin being shot. Michael Dunn shot Jordan Davis after he was trash-talked by a teen over ‘thug music.’ Big difference. No way he will walk free.

#DunnTrial:  Michael Dunn’s lawyer sunk to a new low by holding a press conference while the jury is deliberating. He also said there’s animosity between the family of Jordan Davis and his client’s.  He said the teen’s dad, Ron Davis, had “anger and animosity. Um, you think?

Strolla told reporters that the Dunn family wanted to reach out to Davis family but is somewhat afraid of backlash. Really? If they wanted to, they could have found a way to do so.

Cory Strolla, who is seeking his 15 minutes of fame, said Michael Dunn has “become quite friendly” with some of the young men he has come to know in jail. Purely for safety. He also said his client threatened with rape by one of his jail mates. Um, that’s the tip of the iceberg. I can guarantee that this won’t be the last time.

He also said that race wasn’t a factor in the case and neither he nor his client made it such. Um, Michael Dunn made it about race when he used the word “thug music” to describe the loud music coming from Tommie Stornes’ SUV at the Gates gas station.

Cory Strolla told reporters that Michael Dunn went through through a “culture shock” in jail because he had a prejudice (pre-judging) of those in jail. Didn’t realize anyone could ever thing they were going to Club Med when they are incarcerated.

The bigger question for me is why there are no black males on the jury.

#DunnTrial:  Michael Dunn took the witness stand in his ‘thug music’ murder case and he didn’t bat an eye, even after he was caught in several inconsistencies. Dunn claimed he riddled Tommie Stornes’ SUV with bullets because he feared for his lift. He said, “I thought I was going to be killed.” Um, that’s after he suddenly grew bionic ears and heard Jordan Davis’ profanity-laced death threats even though his window was turned up and the music blaring from the SUV. He claimed during his testimony that he had little hearing in his right ear due to a scuba diving accident as a child.

Dunn, who was dressed in a white shirt, green sweater and tie, choked up when he talked about his girlfriend and their dog Charlie. Er, no remorse for the 17-year-old trash-talking kid he gunned down. The shooting occurred at a Gate Gas Station where Dunn and his fiancée, Rhonda Rouer, stopped to buy white wine and chips on their way back from his son’s wedding. Um, this is the son who had only seen him three times in 15 years. Some close relationship, right?

Dunn said that the music wasn’t playing when they parked next to the SUV, though his girlfriend was pretty clear on what he said about the music — “I hate that thug music.” He got on the witness stand and denied saying that. He claimed he said, “that rap crap.”

He said, “My rear view mirror was shaking, my eardrums were vibrating. It was ridiculously loud.” Most people, would simply find another parking space or leave quickly after purchasing whatever they came to buy. I certainly would not start an argument with anyone over loud music, much less pull out a gun and shoot when they got the better of me. The fact remains, Michael Dunn could have just driven off and all this would have been avoided.

Instead of taking the high road, Dunn said the young men in the Dodge Durango started using expletives after he asked them to turn the music down. They complied but turned it back up with Jordan Davis instructed them to. He said, “I start hearing things like F-him and F-that.  It was mean-spirited.” #YouThink?

Michael Dunn and Rhonda Rouer fled the scene and later ordered pizza and walked the dog. At no time did either of them bother to call the police. They both had cellphones and had a phone in their hotel room. If Michael Dunn truly acted in self-defense, he could have left the gas station, pulled into a safe location and called the cops to report the shooting. Instead, he chose to lay low for a few days. He has such a sense of white entitlement that he felt he could chose which officer he wanted to tell his version of the shooting. He called a neighborhood cop to divulge the series of events that led up to Jordan Davis’ murder. He claims the officer called him at the request of a mutual friend, but prosecutor John Guy got him to admit, after producing phone records, that he was the one who called that officer. Boom. Another inconsistency.

Cory Strolla, Dunn’s attorney, told the jury in his opening statement that his client only started shooting after seeing what looked like the barrel of a gun or a lead pipe through the Durango’s back passenger window and that he acted in self-defense because he was in imminent danger. Um, the last time I checked, you can’t just shoot someone because you thought they had a gun. Yeah, Cory Strolla spun a lot of fairy tales during the course of the trial and it will only backfire for his client. Dunn also claims that Jordan Davis attempted to get out of the SUV, even opening the door. The fact is, his car and the Dodge was parked a little too close for comfort and there was no way Jordan Davis could have alighted from that vehicle without hitting Dunn’s car. There was no-0ne to corroborate Dunn’s assertion. The fact is, police found no weapon in the Durango after the shooting. The fact is, Jordan Davis was leaning to the left, away from Michael Dunn when he was shot three times.

The prosecutor hit a home run when they asked Michael Dunn if he had told Rhonda Rouer that he saw a gun in the teens’ SUV after the shooting. He said he told her multiple times. Um, one problem….Rhonda Rouer said he had not. Boom. The fact is, she showed that Michael Dunn is a LIAR. So much for that wedding….I found her to be a credible witness, though I believe there were grounds for her arrest, but the cops were really after Michael Dunn.

The prosecution also introduced his racist jailhouse letters. Boom. The prosecution also played parts of the interrogation tape conducted by Dets. Marc Musser and Travis Oliver. It clearly showed the cops did not believe what Dunn was saying and they challenged him on his inconsistencies.  The police told Michael Dunn, “law doesn’t allow me to shoot them because I think they have a weapon.”

Stay tuned for closing arguments, which are expected to start at 10 a.m. Wednesday, followed by jury instructions and then the fate of Michael Dunn will be in the hands of the jury.  Dunn is being tried on one count of first-degree murder, three counts of attempted first-degree murder and one count of firing a deadly missile into an occupied vehicle on November 23, 2012, that led to the murder of Jordan Davis. This latest shooting thrusts Florida, dubbed the #GunshineState, in the national spotlight for the “Stand Your Ground” law that must be repealed.

By the way…..Michael Skolnik, editor of Russell Simmons’ Global Grind, issued a public apology to Jordan Davis’ parents. Um, really? The one who should be apologizing for this crime are Michael Dunn and Rhonda Rouer and people who take the law into their own hands. Skolnik wrote:

On behalf of the people of the United States of America, I would like to publicly apologize to the parents of Jordan Davis, Ron Davis and Lucia McBath.  Mr. Davis and Ms. McBath, we owe you our deepest regrets for the loss of your son.  We beg for your forgiveness for not protecting one of our own. We are embarrassed by the consequences of our lack of participation in the political process that has allowed laws to be passed that encourage the citizens of this nation to shoot first and get asked no questions later.  This land is your land, yet with no explanation, your son was killed on his own soil.  It is our greatest hope and prayer that this nation, our nation, one nation, indivisible, with liberty and justice for all, delivers justice for the death of your child.  A child who has been defined by “loud music,” yet it is the melody of your grace and compassion that deserves a harmonic apology.  And it will be you who defines the legacy of your son, not any media outlet and certainly not the outcome of a murder trial.

SHOCK #DunnTrial #MichaelDunn #JordanDavis:  The Duval County Medical Examiner Stacey Simons says Jordan Davis also had a gunshot wound to the groin area. His black Fruit-of-the-Loom boxers was on display. He was also shot through his black tank top. He had three gunshot wounds to the body. The description of the body and the gunshot wounds are really upsetting to me. Sad to know that Jordan Davis is known to the Medical Examiner as Case Number 12-1982.

Bullet Wounds:  One of the three bullets was penetrating — the bullet entered the body and didn’t not leave. It had an oval affect, meaning the teen was hit at an angle. The wound is consistent with a large caliber bullet being fired into Jordan Davis. It entered and perforated the 10th rib. It perforated the diaphragm, perforated the liver and perforated the right lung and went behind the heart, perforated the aorta. Rested below the ribs and the skin after fracturing two ribs. It was recovered from the left chest area of Jordan Davis. The second bullet penetrated the left leg and the third perforated the right leg. Path of the bullets indicate Jordan Davis may have been leaning over and to the left.

Dr. Simons says Michael Dunn was close to ground when he fired shots. That backs up Shawn Atkins’ claim Michael Dunn was in “police pose” when shooting the teen.

Rhonda Rouer Testifies Michael Dunn Said “I Hate That Thug Music” Before Jordan Davis Killed

#DunnTrial:  Rhonda Rouer, Michael Dunn’s fiancée , gave a very emotional testimony in the murder of unarmed black teen Jordan Davis, as he sat in his friend’s SUV. Rouer said when they arrived at the Gate gas station Michael Dunn said “I hate that thug music,” (#Thugmusic) in reference to the loud music emanating from the teens’ SUV. That was a very powerful statement because it shows that Michael Dunn had already made up his mind that Jordan Davis and his friends were thugs.

It’s also very damning that after the shooting, Dunn ordered her to get in the car and they left the scene. Even passing a police officer or calling 911. Seems to me like Michael Dunn’s fiancee rightfully threw him under a bus. There’s no way this man can walk free.

Rouer said when they went back to the hotel, Dunn ordered something to eat, hoping it would help allay her fears. She said she was watching television when she heard about Jordan Davis’ death. She testified that she couldn’t say what he said in response but they returned to Brevard County because she insisted that they did and she was very scared.

Rhonda Rouer ended her testimony by saying she was sorry, but it’s not clear to whom that was directed. It seems to me, Rhonda Rouer basically helped the prosecution and not the defense. I have to ask why Rhonda Rouer didn’t ask him more about the shooting as they left the gas station. Was she afraid of him? She could have easily been arrested by the cops.

Officers, Friend Tevin Thompson Testify in Jordan Davis Murder Trial

:  Officers Robert Holmes and Dawn Valentine with the Jacksonville Sheriff’s Office testified on Friday in the Jordan Davis murder case. Tevin Thompson, a friend of the teen who was in the SUV at the time of the shooting, also testified.

The officers said that Jordan Davis died almost immediately after being shot by Michael Dunn, over an altercation about loud music (#thugmusic). The officers said the teen was found slumped against another young man in the backseat of the SUV. Officer Holmes said blood was coming out of his back.

Tevin Thompson said Michael Dunn aimed the gun at the SUV door and fired. He also said Dunn told them to “turn the music down, I can’t hear myself think.” He should have driven home for that.

Michael Dunn, who fled the scene after the shooting, pleaded not guilty and said the shooting was in self-defense. Um, yeah, right. It should be noted that Jordan Davis was dead when the cops arrived on the scene and Michael Dunn had fled the scene. Can’t call it self-defense.

Leland Brunson, who says Jordan Davis was his best friend, also testified. It has been reported that Davis died with his head in his lap. Tommie Stornes was also in the vehicle. Leland Brunson recounted the series of events leading up to Jordan Davis’ murder identically.

Brunson said Jordan Davis told Dunn f*ck you after being asked about turning the music up. He said Jordan Davis put his had on the door, but didn’t open it. He said Jordan Davis didn’t put his hands out of the car door like a gun. He had a cell phone in his right hand. Brunson said Tevin Thompson raised Jordan Davis’ window during the altercation. Brunson said Jordan Davis was gasping for air after he was shot. He also said Michael Dunn continued to fire at the SUV after they drove off. Wow. This was clearly not a case of self-defensse.

As George Zimmerman continues to thumb his nose at Trayvon Martin’s family, an opponent has been chosen to go against him in his celebrity boxing match. Rapper DMX was chosen out of 15,000 applicants. I am guessing he can’t wait to kick his you know what.  Um, I hope the version of DMX that shows up to that boxing match is the same person who went off on Iyanla Vanzant in the most disgraceful way.

…the rapper tells TMZ he wants to fight on behalf of “every black person who has been done wrong in the system…I am going to beat the living f*ck out of him.
