WV State Trooper Marshall Bailey Killed By Luke Baber in Custody in Back of Squad Car

FALLEN LAW ENFORCEMENT OFFICER:  West Virginia State Trooper Marshall Bailey was shot and killed after he and another trooper stopped a vehicle for reckless driving Monday night near Wallback I-79 Interchange. The suspect, thought to be Luke Baber of Oak Hill, was arrested and placed in the back of the squad car when he was able to get out of his handcuffs, drew a concealed weapon, killing Trooper Bailey and wounding another trooper.

After climbing out of the vehicle he shot a tow truck driver who had been called to the scene to impound his car. The man then fled on foot and setup an ambush in a ditch. Approximately one hour later he opened fire on a Roane County Sheriff’s Deputy [John Westfall] who was searching for him, wounding the deputy in the arm, hand, and stomach. The injured deputy was able to return fire, killing the subject. Source

A tow truck driver from Clay, Frank Massey, was also shot when he responded to the scene. Massey was shot in the arm, reportedly when he was commencing to tow the suspect’s car. He has been released from the hospital. Source

Our thoughts and prayers go out to the family of Trooper Marshall Bailey. His younger brother, Justin Bailey, said he recently separated from his second wife and leaves behind three children: Whitney, 22, Lauren, 6, and Wyatt, 4. Trooper Marshall Bailey was 42 years old, according to ODMP.
