Abbott Says Legislative Action Needed to Address Ankle Monitor Violations

Austin. Gov. Greg Abbott on Wednesday sent a letter to Lt. Gov. Dan Patrick and House Speaker Dade Phelan calling for legislative action during the 88th Legislative Session to introduce criminal penalties for parolees who turn off their monitors. on the ankles and give priority to their arrest. and concerns.

Last month, Abbott directed the Board of Pardons and Parole of Texas (BPP) and the Texas Department of Criminal Justice (TDCJ) to investigate any lapses in overseeing the release and parole of Nestor Hernandez and Zerik Jackson and submit a report to the Governor’s Office. .

In recent months, the two prisoners, who were released on parole, continued to commit murder while wearing monitors on their legs as a condition of their parole, Abbott said.

“In neither case were ankle monitors an effective deterrent to the heinous crimes they committed. While nothing can be done to bring back these victims, Texas must protect the people of Texas from acts like this,” Abbott said.

Now that Abbott has received the report, it says clear legislative action is needed.

“It is clear that the ankle sensors that are a condition of their parole were not effective in deterring or otherwise preventing these individuals from committing violent crimes that resulted in the death of three innocent people,” the letter says. “Based on the report, it becomes clear that legislative measures are needed. There are currently no criminal ramifications for parole disabling an ankle monitor. Texas cannot allow violent criminals who endanger public safety back into our communities. I look forward to working with you to implement these changes and other legislative initiatives that will keep our fellow citizens safe.”

Abbott included the joint BPP and TDCJ report in a letter to Patrick and Phelan.
