The Cook County State’s Attorney office says Empire actor Jussie Smollett has been charged with felony disorderly conduct for filing a false police report.
Smollett claimed he was the victim of a racist and homophobic attack in downtown Chicago. It turns out he allegedly paid two brothers to help him stage the attack.
Smollett claimed his attackers shouted “this is MAGA country” and hung a noose around his neck. The attack unraveled after police arrested the two Nigerian brothers, who told investigators they were paid by Smollett to stage the attack.
State’s Attorney Kim Foxx released a statement saying “shortly after the incident,” she had conversations with a member of Smollett’s family and “out of an abundance of caution,” she decided to “remove herself from the case.”
A bond hearing is set for Thursday at 1:30 p.m. The Chicago police said “detectives will make contact with his [Smollett’s] legal team to negotiate a reasonable surrender for his arrest.”
