WICHITA FALLS (KFDX/KJTL) – A man faces multiple charges after police say he assaulted his 71-year-old brother and grandmother, then ran away from home after the victim contacted authorities.
Xavier Anthony Perez, 26, of Wichita Falls, is charged with the felony misdemeanor of harming a child, elderly or disabled person, as well as the lesser misdemeanor counts of assault causing bodily harm, family violence and interfering with an emergency assistance request.
Perez was incarcerated in the Wichita County Jail on Monday, January 30, 2023, where he remains on bonds totaling $14,500.
According to the arrest affidavit, Wichita Falls Police Department officers responded to a residence on Grant Gill Lane shortly after 10:45 p.m. on Sunday, January 29, 2023, in reference to an assault.
Authorities said officers were alerted before they arrived at the scene that a subject said his brother had assaulted his grandmother. Dispatch then advised that there was no more response on the line except shouting in the background.
Police said when they arrived, they made contact with one of the two victims, who said his brother assaulted him and his grandmother, then left the scene on foot before officers arrived.
The victim told police her brother, whom she identified as Perez, was “crazy and acting out,” and that her grandmother allegedly called the police.
The victim said Perez then got angrier and pushed his grandmother onto the couch and was trying to take her phone to stop her from calling the police.
According to police, the victim said she snatched Perez from her grandmother and said she would call the police, then pulled out her phone and called 911. The victim told police Perez said, “I’ll give you a reason to call the Highway Patrol.”
The affidavit said the victim then began backing away into the kitchen while on the phone with the caller. She said Perez punched him four times on the left side of the face with a clenched fist and that Perez was trying to take his phone away from him as he punched him.
The victim told police that as Perez was assaulting him, he fell into a coat rack in the kitchen. She said Perez realized the call to the police had already been made, so he ran out of the house.
The officer noted in the affidavit that he observed the victim’s swollen face, as well as a knocked down coat rack in the kitchen.
According to the affidavit, police then spoke with the grandmother of Perez, the other alleged victim. She gave the same recollection of the events to the police and said she felt pain in her back because she is 71 years old and fell too quickly on the sofa. She said she wanted to press charges and would call the police if Perez returned to the residence.
Police said officers searched the area but were unable to locate Perez.
According to authorities, WFPD officers were sent back to the residence a few hours later on Monday, January 30, 2023, at around 2:30 am after receiving a call from the first victim that Perez was at the front door and was attempting to enter the residence by knocking on the brings.
When police returned to the scene, they said they saw Perez standing at the door, where he was arrested.
