Mother sues Olathe daycare, saying her baby was bruised and owners didn’t show up

A Johnson County mother is suing an Olathe day care center, alleging that her 6-month-old received bruises on his back and arms while the baby was being treated.

According to a lawsuit filed in Johnson County District Court, plaintiff Blanca Martinez-Gomez sent her son to a day care center operating as Laura Baby Sitter LLC, located near West 111th Terrace and South Penrose Street. You paid the defendant’s weekly tuition for an undisclosed period of time.

While in daycare on May 26, 2021, the boy reportedly sustained multiple bruises.

Martinez-Gomez reported the incident to the Kansas Department of Children and Families the same day, while Laura Baby Sitter allegedly failed to report it. An investigation by the DCF confirmed that the boy had several bruises on his body, according to the cause.

Details of the incident are not mentioned in the court documents.

The mother is suing the day care center for negligence, claiming it failed to protect her son from abuse and instances of corporal punishment “such as spanking with hand or any implement, slapping, slapping, hair pulling, arm jerking or any similar business.”

The lawsuit also alleges that the defendant failed to adequately train and monitor health care workers.

Laura Baby Sitter declined to comment on the litigation.

Martinez-Gomez’s attorney, Elizabeth VanErem of the law firm Edelman & Thompson, said she could not talk about the ongoing lawsuit, especially as it involves a minor.

DCF said it could not provide details about the incident or confirm that an investigation had taken place.
